Abstract

After serving the sentence, the convicted person returns to society and is included in regular social life, but the person is still not completely equal to other citizens in terms of the scope and type of rights available to him. This leads to the effect of certain legal consequences of the conviction, which can consist of: limiting the acquisition of certain rights and taking away existing rights. Precisely in order to reduce the limiting effect of such negative consequences of a court conviction, all modern criminal legislations recognize the institute of rehabilitation, thereby determining the conditions, method and procedure for its application. This paper is about the concept, characteristics and effect of the application of rehabilitation in the new criminal law of the Republic of Serbia, which entered into force on January 1, 2006.
