Visa Policy of the Republic of Serbia in the Context of the Migrant Crisis and Accession to the European Union

Abstract

Serbia's decision to abolish visas for citizens of some third countries has caused concern in the European Union. In the conclusions of 26 June 2018, the EU Council urged Serbia to refrain from derogations from a common EU visa policy. The conclusions of the EU Council were endorsed by the European Council at its meeting on 28 June 2018. A special reason for the concerns of the European Union was the lifting of visas for Iranian citizens. Iran is a state on a migrant route. Refugees from Afghanistan and Pakistan are moving across the territory, moving further towards Turkey and the European Union. After the abolition of visas, there was an increase in the number of Iranian citizens who, through Serbia and then Bosnia and Herzegovina, continued their path towards the EU. In this paper, the author considers the obligations arising for Serbia from international agreements with the European Union regarding visa policy. The author also analyses the obligation of aligning Serbian legislation and policies with the EU visa policy in the context of accession to the EU.
