Some Thoughts on the Adequacy for Delineation of Responsibilities Between the Police and Intelligence and Security Agencies

Text contains reflections resulting from scientific work on Project 47011, related to the fundamentals, appropriateness, and necessity of demarcating jurisdiction and mandates for evidence collection between intelligence agencies and the police. This, especially, having in mind the possible or questionable validity of the evidence against crime, which affects public safety, but is obtained by intelligence agencies. Text also points out the wrong legal, for this reason, also the wrong practical treatment of the intelligence agencies as law enforcement agencies. Our text is aimed at understanding the foundations, roads and ways of correcting the identified problems, starting from law-theoretical, but also pointed at possible practical ways of solving the perceived problems. It provides a vision of the authors presented as a sort of conclusion, and on which they are based, proposals.
